Cusco Tours Peru, also known as the Company in this document, wants you to enjoy the most of your vacation in Peru, so we recommend you to read carefully and obey the instructions of your sales agent.
Cusco Tours Peru is considered one of the safest agencies in Cusco.
Please read the following conditions carefully, as it is your contract with Cusco Tours Peru, by booking a trip with Cusco Tours Peru, you agree to be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain limitations of liability at the time of booking.
The quotation given by us will be valid once the reservation is confirmed, from which time you will be able to ask all questions regarding your vacation, Cusco Tours Peru will be happy to answer all questions for you. Quotes do not apply to international flights to and from Peru. If you want us to assist you on international flights or flights within Peru, the flight must be paid immediately and purchased on the same day or, if possible the next day to ensure the validity of the offer, as prices vary from day to day.
Our prices do not include meals not specified in your itinerary, personal expenses, personal insurance, and luggage transportation.
1. THE CONTRACT
The contract is between Cusco Tours Peru (also known as the company) and the client, who is the person traveling or intending to travel on a tour operated by the company. You, the client are subject to have read and understood our travel policy as stated below. By making a reservation by telephone, or through the website, or by email or fax, you accept and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the Customer relating to the subject matter hereof, and shall constitute a binding agreement. There is no oral or written representation, warranty, guarantee agreement, prior agreement, description of services, or conditions or any promise of reimbursement other than as expressed herein. The service to be provided is/are the tour(s) mentioned in the booking confirmation.
These conditions only apply to the services in our program and not to international and domestic flights. These are subject to the conditions imposed by the airlines.
2. SECURING YOUR RESERVATION
To guarantee the reservation, Cusco Tours Peru requires a completed reservation form (either the one on our website or the one sent by us with your quote), along with the payment of the necessary deposit. The prudent time to make your reservation is 30 days prior to your trip to Peru, a reservation is accepted and becomes final only from the date on which your deposit is received and at that time a contract exists. 3. CUSTOMER DATA
To confirm and guarantee the Clients travel arrangements the client must provide all their identity details with the initial payment or no later than 30 days prior to the start of the trip. Customer details include passport number, copy of passport details and medical form (if applicable), full name, date of birth, international flight information and nationality, case or cell phone for any emergency.

4. FINAL PAYMENT / SURCHARGES
In order for the company to be able to confirm and guarantee the client’s travel arrangements, the client must provide all the client’s information with their final payment at the beginning of the tour.
Surcharges: To avoid surcharges on your vacation make your reservation in advance, do not change your hotel at the last minute.
5. IF YOU CHANGE YOUR RESERVATION
An administration fee of US$50 per person will be charged if the confirmed reservation is changed or transferred to a different departure date or tour, up to 30 days prior to your trip. Thereafter all changes will be treated as cancellations and subject to charges as follows.
If a client is not able to travel, and mentions us about 20 days in advance, in circumstances that Cusco Tours Peru considers reasonable, then the reservation may be transferred to another suitable person, or your money will be refunded minus 20% as 10% goes to money transfer payments and the other 10% is administrative fees, your money will be refunded in less than 15 days.

6. CHANGES
The company reserves the right to change any of the facilities, services or prices described in the brochure or website. If such a change is made, the client will be informed at the time of booking or when the change occurs. While the Company will endeavor to operate all tours as advertised, reasonable changes to the itinerary may be made when deemed necessary or advisable by the Company due to external factors beyond the Company’s control.

7. CANCELLATION POLICY – RIGHT OF WITHDRAWAL
Confirmed reservations will have a cancellation policy in the following terms:
- Cancellations or changes to paid reservations have a penalty of 50% of the total value of the package and will be made within a maximum of 60 calendar days after receipt of the request.
- Cancellations or changes between 8 and 1 day before the departure date have a penalty of 100% of the total value of the package.
- The air tickets of commercial airlines or charter flights included in the reservation are non-refundable, in case of cancellation the flights will remain in the name of the reservation takers who may use the tickets in a period of 1 year, paying the penalties and fare changes at the time of use.
8. COMPLAINTS
If the client has a complaint about any of the tour arrangements, it is a condition of the contract that they tell our local representative at that time. If they do not complain at that time, if they later deny us the opportunity to investigate and rectify the problem and so do Cusco Tours Peru cannot accept any liability. If the customer has a dispute with Cusco Tours Peru and cannot resolve it, please write to us within 28 days of your return and we will investigate further.

9. TRAVEL AND CANCELLATION INSURANCE
Travel insurance is highly recommended for all clients who book we recommend that it should cover personal injury, medical expenses, repatriation expenses, evacuation expenses, cancellation and curtailment. It is our policy to check the validity and coverage of your insurance policy and we reserve the right to refuse transportation to anyone whose insurance does not meet these criteria. If you choose not to purchase travel insurance, you will be required to sign a waiver form acknowledging your acceptance that insurance is recommended but declined and should you need to change or cancel your trip or if you incur expenses such as medical expenses, you will be responsible for all such additional costs.
10. MEDICAL FORM
For insurance purposes all clients are required to complete our Cusco Tours Peru form, which must be signed and dated by a practicing physician (if there are pre-existing conditions) and sent to us no later than 15 days prior to the start of your trip.
11. FINANCIAL SECURITY
Cusco Tours Peru is a travel agency accredited Ministry of Tourism and registered as a corporation with the Ministries of Tourism office of Peru. Cusco Tours Peru complies with the European standards in force regarding the protection of the client’s money.
12. CUSTOMER RESPONSIBILITY
The client agrees to accept the authority and decisions of Cusco Tours Peru employees, tour leaders and agents while on vacation. If in the opinion of these persons, the health or conduct of a client at any time before or after departure appears to jeopardize the progress of the safety, comfort or tranquility of the tour, the client may be excluded from all or part of the tour.
Clients must be in possession of their respective identity documents, and are responsible for carrying a valid passport, visa, if applicable, and vaccination certificates required for the entirety of their trip. Your passport must be valid for 6 months after the date of return.
13. OUR RESPONSIBILITIES
Reservations are accepted on the understanding that they appreciate the possible risks inherent in adventure travel and that they undertake the visits, excursions or expeditions, listed in our programs, at their own will. It is also important to understand that the most meticulous arrangements can go wrong.
The company is obliged to provide its services with the necessary diligence, so that the whole trip goes perfectly, we will do our best to take care of you as well as possible.
The Company assumes no responsibility for force majeure, climatic phenomena or natural phenomena which may occur before or during the trip, or for any eventuality which may make any trip uncomfortable or difficult, or for any delay or obstruction of your trip in any way and does not guarantee failure on the part of the Company either for the total or partial performance of the provision of the services which the Company has undertaken to provide which may have been affected by the aforementioned factors.
14. FLIGHTS / DELAYS
We cannot accept any liability for cancellations or delays to any of your flights, whether the cancellation or delay is due to adverse weather conditions, rescheduling by the airline, airport authority and/or the action of air traffic controllers, mechanical failure or industrial action.
Our company will endeavor to arrange your travel itinerary, and that all inconveniences will be resolved and nothing will be affected by air delays.
The Customer must understand and be flexible if due to air delays the problems cannot be solved.
15. CHILDREN POLICY
In all programs, unless otherwise indicated, the maximum age of a child is 11 years and 11 months. Children over 12 years of age are considered adults and will be subject to adult fares.
16. LAST MINUTE RESERVATIONS
For all reservations made within 10 days of departure, there will be a USD $50.00 fee charged to the file. This Last Minute fee covers our additional costs for Hotel suppliers, Train Ticket, Bus Ticket and operating expenses.
